Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the MCS VOIP LLC website, applications, and VoIP communication services (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and authorized to act on behalf of your business or organization to use the Services.

We provide VoIP calling and messaging, call recording and analytics, CRM integrations, and related support/managed services. We may add, modify, or discontinue features at any time with or without notice.

• Provide accurate and complete registration information
• Maintain the confidentiality of login credentials
• Be responsible for all activity under your account
• Notify us immediately of unauthorized use

We strive for high availability, but interruptions may occur due to maintenance, outages, or third‑party network issues. We are not liable for connectivity issues beyond our control, including internet or power disruptions.

• Fees are in U.S. dollars unless otherwise stated
• Billing may be monthly or annual per your plan
• You authorize recurring charges through our payment processors
• Late or failed payments may lead to suspension
• Taxes and regulatory fees may apply

You agree not to use the Services for illegal, fraudulent, or abusive activities; spamming or unsolicited messaging; harassment; transmitting harmful code; or violating telecommunications and data‑privacy laws. We may suspend accounts engaged in prohibited use.

• E911 may not function during power or internet outages
• Register and maintain an accurate physical address for routing
• We are not responsible for failed emergency calls due to user error or connectivity issues

All trademarks, logos, and platform content are owned by MCS VOIP LLC or its licensors. Do not copy, distribute, or modify without written permission.

Your use of the Services is governed by our Privacy Policy. By using the Services, you consent to data processing as described there.

We integrate with third‑party platforms (e.g., CRM, SMS gateways). Your use of those services is subject to their terms and privacy policies. We are not responsible for issues arising from third‑party services.

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose or non‑infringement.

To the fullest extent permitted by law, MCS VOIP LLC and its affiliates are not liable for indirect, incidental, consequential, or special damages; loss of profits, revenue, or data; or interruptions beyond our reasonable control. Our total liability shall not exceed the amount paid by you to MCS VOIP in the preceding 12 months.

You agree to indemnify and hold harmless MCS VOIP LLC, its officers, employees, and agents from claims or expenses arising out of your use of the Services, violation of these Terms, or infringement of third‑party rights.

We may suspend or terminate access for violations of these Terms or for non‑payment. You may terminate at any time by contacting [email protected]. Certain obligations (fees due, indemnities) survive termination.

These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law principles. Exclusive jurisdiction lies in the state and federal courts located in Harris County, Texas.

We may update these Terms from time to time. The updated version will be posted here with a new Effective Date. Continued use constitutes acceptance.
